Client Success Story: Asylum Win

A young, HIV+, bisexual client originally from El Salvador was granted asylum in the United States after being diagnosed with HIV.
Being granted asylum in the U.S. is life-changing. One’s chances of obtaining asylum are difficult to predict, and it is essential to have a good attorney by your side. We want to take a moment to share a recent ALRP success with you.
Under asylum law, even if a foreign national fails to file an application for asylum within one year of arriving in the U.S., they may still be eligible to apply for asylum if they can demonstrate a changed circumstance which materially affects the applicant’s eligibility for asylum. In this case, the client was able to prove a changed circumstance, his recent HIV diagnosis, and that he is eligible for asylum in the United States due to the risk of persecution he faces if he returns to El Salvador as a member of the LGBTQ community and as a person living with HIV.
