- Overview: What affirmative remedies do tenants have when there are problems with the rental dwelling and/or the landlord? While cross-complaints are not permitted in eviction actions, there are a broad range of affirmative actions available to tenants, from repair-and-deduct to civil suit for breach of warranty of habitability, constructive eviction, and several other well-established causes of action. Other less drastic options for dealing with landlord/tenant problems also exist. These tenant remedies will be the subject of this training. Fred Feller received his law degree from Georgetown University and specializes in premises liability, landlord-tenant law, and insurance defense litigation.
