With the rise in the government’s use of pretermission motions to deny meritorious asylum claims, learning how to challenge these motions becomes more important every day. This training will focus on the caselaw and policies underlying pretermission motions (Matter of CARR-, Matter of H-A-A-V- and Asylum Cooperative Agreements) and teach you how to oppose them in LGBTQ+ and HIV+ asylum cases using a combination of legal arguments and country conditions.
