Are Courts Dying? The Decline of Open and Public Adjudication

During the twentieth century, courts were transformed into venues in which all persons become eligible for “equal justice under law.” But the twenty-first century may become known for a retrenchment – marking courts’ decline and rendering obsolete the constitutional guarantees of “open” and “public” courts for both civil and criminal litigants. In this program, state supreme court justices and federal judges will discuss why open, public, independent courts remain important and how to respond to a combination of pressures – decreased court funding despite a growing number of litigants without resources, the cost of lawyers, contracts mandating outsourcing adjudication to arbitration, and other efforts to privatize decision making. This is a complimentary CLE program.
