  • Overview: Discuss strategies for negotiating lawsuits with an emphasis on personal injury, insurance and malpractice claims, yet also applicable to other types of disputes/litigation. Topics will include:
    • Points to consider on taking the case — is this a case that CAN be settled or am I in for a trial?
    • Cases that are ripe for early negotiation and how to get it done THEN!
    • Working towards a “plateau” where settlement is most likely.
    • What should a persuasive demand letter contain — make it a “claims file”.
    • How to make “direct negotiations” work for you and your client.
    • When is it best to mediate?
    • The ten mistakes not to make in negotiating your client’s case.
